KD Demand

Privacy Policy

Version 1.0 of

The legally binding text is the Spanish (es-AR) version. This English version is provided for convenience.

Hi. Here we explain, plainly, what data of yours we use on kdagencia.com and in our chats, why, who we share it with, and what you can do about it. If anything is unclear, write to [email protected] and we'll get back to you.

1. Who we are

The owner of kdagencia.com is KD Agency S.A., an Argentine corporation (sociedad anónima; CUIT 30-71846861-9, the Argentine tax ID), at Vera 256 (C1414), Ciudad Autónoma de Buenos Aires, Argentina. Our brand is KD Demand.

KD Agency S.A. is the data controller (responsable) for the databases described in this policy, within the meaning of Ley 25.326 (Argentina's Personal Data Protection Law).

2. The essentials in 30 seconds

  • We only ask for what we need: if you write to us by email or on Telegram, your contact details and your message.
  • We don't sell your data or use it for other projects.
  • We count visits with a tool that doesn't use cookies and doesn't identify you. You won't see a cookie banner: we don't use analytics or advertising cookies.
  • On Telegram you'll be answered by our team.
  • We don't tell ad platforms where you came from.
  • You can ask to see, correct or delete your data whenever you like.

3. What data we use, why, and on what basis

3.1. If you email us at [email protected]

DataWhyLegal basis
Your name, email, message and whatever you tell us (for example, your company)To reply and, if you want to work with us, to prepare a proposalYour consent (you're the one writing to us) and, if you are or are about to become a client, the pre-contractual or contractual relationship (art. 5(2)(d), Ley 25.326)

If you write to us about a correction, a right of reply or a copyright claim, we use your data only to handle that request (see the Terms of Use).

3.2. When you browse the site

  • Visit statistics. We use Umami, an analytics tool that sets no cookies and keeps no data that identifies you. We see page views, where visits come from (including UTM tags), browser, device type, approximate country and the browser's time zone (for example, America/Argentina/Buenos_Aires), so we better understand where our visitors are. Some events (for example, "submitted the subscription form") are recorded without your email. We use Umami Cloud, with servers in the US.
  • Where your visit came from. If you arrive from an ad or a link with UTM tags, we keep that information in your browser's session storage (sessionStorage), which clears itself when you close the tab. We use it only in Umami's anonymous statistics (which source and campaign led to a click on a contact button). It is not added to your inquiry or to the chat with the bot.
  • Language preference. If you choose a language, your browser remembers it so we can show you that version next time.
  • Technical logs and security. Our hosting and network provider (Cloudflare) processes your IP address and the technical data of each request to deliver the page and protect the site from attacks.

We don't use analytics or advertising cookies, so we don't need a cookie banner. Details: Cookie Policy.

3.3. If you write to us on Telegram

The "Create demand" button on the site takes you to our chat on Telegram (@GeneratorSprosaBot, https://t.me/GeneratorSprosaBot). There you'll be answered by our team: we answer questions, take your inquiry and help you book a call with our CEO.

On Telegram we use the following data:

DataWhyLegal basis
The account details Telegram shows us when you write: your name and username (if you have one)To reply in the same chat and recognise your inquiry if you write againYour consent (you're the one writing to us) and, if you are or are about to become a client, the pre-contractual or contractual relationship (art. 5(2)(d), Ley 25.326)
Your messages and what you tell us about your businessTo understand your inquiry, prepare a short summary for our founder and, if you wish, book a callSame as above
Where you came from: the inquiry code from the site, the landing page, the referring page (referrer), the contact method you chose (Telegram, calendar)To see which content and campaigns bring inquiries, and to handle each inquiry in orderKept together with the inquiry you choose to send us (art. 5(2)(d), Ley 25.326). We don't share it with ad platforms

If you agree to a call, we book it in our Google Calendar and send you a Google Meet video link and a calendar file (.ics). The event itself contains only the name you gave, the date and time, the time zone, a short internal inquiry number and, if you preferred another service instead of Meet, its name. The chat text, your phone number and your username are not added to the event. Legal basis: preparing a possible collaboration at your request (art. 5(2)(d), Ley 25.326). Google processes this data in the US under its own policy.

If you open the bot but never write, the record and the source data are deleted 90 days after your last interaction with the bot.

In the chat we don't ask for sensitive data (health, religion, political opinions and the like), card numbers or passwords. Please don't send them in the chat. We also don't agree prices or terms in the chat: we make proposals in writing. If you send a voice message, we convert it to text to understand your request; we don't keep the audio file itself — it is deleted right after transcription; the transcript is kept under the general rule (see section 6). A copy of your voice message stays on Telegram's servers under Telegram's own policy.

Telegram also processes your data under its own privacy policy.

4. Who we share your data with

We don't sell or rent your data. We share it only with providers who perform a service for us and process the data on our behalf (art. 25, Ley 25.326 — data processors):

ProviderWhat it doesWhere the data is
Cloudflare, Inc.Site hosting, DNS, securityGlobal network; US-based company
Umami Software, Inc. (Umami Cloud)Cookie-free visit statistics (receives no data that identifies you)US

Google LLC (Google Calendar and Google Meet)Creates and stores the event for a booked call, with the video meeting linkUS

We may also disclose data to an authority when a law or a court requires it.

5. Data that travels outside Argentina

Some providers store data outside Argentina, in countries that the AAIP (Agencia de Acceso a la Información Pública, Argentina's data protection authority) does not consider to offer an adequate level of protection (Disposición DNPDP 60/2016, as amended — the AAIP's rules on international transfers). That's why:

  • we work with providers that have data processing agreements (DPAs) with confidentiality and security obligations.

If you live in the European Union: Argentina has an adequacy decision from the European Commission (2003/490/EC), and transfers to the US rely on the safeguards described above.

6. How long we keep your data

7. Your rights and how to use them

At any time and free of charge, you can:

  • Access your data: find out what we hold, where it came from and what we use it for. We reply within 10 calendar days (art. 14, Ley 25.326).
  • Correct, update or delete your data: we do it within 5 business days (art. 16, Ley 25.326).
  • Ask us to remove or block your data in our databases, in full or in part (art. 27(3), Ley 25.326).
  • If you live in the EU or another country with similar laws, you can also object, ask us to restrict processing or for data portability, and complain to your data protection authority.

These rights apply equally to data you gave us through the site or by email, and on Telegram.

How: write to [email protected] from the same email address you used to contact us (or tell us how we can check it's you), or ask in the same Telegram chat. No special form needed. If you don't get an answer within the legal deadlines, you can file a complaint with the AAIP or bring a habeas data action (the Argentine court action to protect your data).

Text required by Argentine law (quoted verbatim in Spanish):

LA AGENCIA DE ACCESO A LA INFORMACIÓN PÚBLICA, en su carácter de Órgano de Control de la Ley N° 25.326, tiene la atribución de atender las denuncias y reclamos que se interpongan con relación al incumplimiento de las normas sobre protección de datos personales.

Translation: The Agency for Access to Public Information (AAIP), as the supervisory authority under Law No. 25.326, has the power to handle complaints and claims filed regarding non-compliance with personal data protection rules.

8. How we protect your data

Access only for those who need it, two-factor authentication on service accounts, API keys with limited permissions, encrypted connections (HTTPS) and separate databases for each project. No system is 100% secure: if an incident happens that could affect you, we'll let you know and take steps to contain it.

9. Minors

Everything we offer on the site and in our chats is meant for adults and businesses. It is not aimed at anyone under 18, and we don't knowingly collect their data. If you are a parent or guardian and think a minor has written to us, let us know and we'll delete their data.

10. Who this site is for

We are an Argentine company, and the site is available in several languages for an international audience. The site is not specifically aimed at people located in the Russian Federation.

11. Changes to this policy

If we change something important (for example, a new provider or a new use of your data), we'll update the version and date at the top and let you know on the site before the change takes effect. If the change needs fresh consent, we'll ask for it. Previous versions are available on request.

12. Governing law

This policy is governed by Argentine law, in particular Ley 25.326, Decreto 1558/2001 and the AAIP's rules, without prejudice to the rights the laws of your country of residence give you.
